What is IMM5802?
IMM5802, Offer of Employment to a Foreign National Exempt from a Labour Market Impact Assessment (LMIA), is an application form used by a Canadian employer to start the work permit process to hire a foreign worker. In order to launch the procedure, an employer first needs to submit the completed form via email, together with the employer compliance fee.
However, recently Citizenship and Immigration Canada (CIC) declared that it has started a new electronic application system that is intended to be used for employer-specific work permit applications under LMIA exemption. It also covers applications made through NAFTA and International Mobility programs.

According to the new system, there is no requirement by CIC to submit the IMM5802 – offer of employment form. Instead, employers will use an online Employer Portal in order to submit their applications. Every employer hiring a foreign worker must register GCKEY or the Sign-In Partner in order to have access to the Employer Portal.
Employers must submit an employer portal application before the submission of the work permit applications. Being on behalf of the foreign worker, employers are assigned an offer of employment (Labour Market Impact Assessment [LMIA]-exempt) ID number when they complete the submission. The work permit application is enabled for evaluation by the foreign national ID number, which is included in the application.
Please note that employers are not allowed to use the IMM5802 form without the authorization of IRCC. In all circumstances, it is a requirement for the employers to contact the Employer Portal mailbox first. To provide the consistency of the program integrity IRCC set this requirement as a key factor.
