Quebec’s new regulation: Protection of Temporary Foreign Workers
According to the Government of Quebec, the new directive will focus on the protection of temporary foreign workers. The measures are intended to monitor hiring agencies and as well as employers of temporary foreign labor. The regulations are expected to come into effect on January 1st, 2020.
According to the government, after the implementation of new regulations, temporary foreign workers will be protected from uncertain practices by hiring agencies.
New measures will set a requirement for recruitment agencies to have a permit to operate for temporary foreign workers. Let us note that, there are a number of agencies that already operating by offering services. Those firms now need to apply for the provincial commission which sets labor standards in Quebec.
Agencies must get authorization for the period of time between January 1 and February 14, 2020, in order to continue to operate.
In order to have control over their performance and operations, the CNESST will monitor recruiters to watch how they comply with the new rules.
While talking about the new regulations that are planned to come into effect next year, said Jean Boulet, Minister of Labour, Employment and Social Solidarity stated that those new rules will make sure that agency workers and as well as temporary foreign workers were entitled to fair and equal working conditions. He also noted that new measures will enable both parties to gain positive work experience.
What does the Protection of Temporary Foreign Workers include?
The new rules include some conditions and if an agency fails to comply with regulations set by the government, then it may face suspension or total cancellation of its license for operation.
Additionally, recruitment firms and client agencies will jointly become responsible for temporary foreign workers.
There will be a new requirement set by the law which makes it necessary for agencies to provide 15.000 CAD security deposit. The amount is determined for compensation of workers in case of non-payment of amounts due to them by the employer that they work for.
From January 1st, next year, recruitment firms paying lower salaries for workers than the staff of the client company that responsible for the same tasks and obligations in the same enterprise will not be able to continue their operation.
While inequality originating solely from employment status will not be tolerated, the salary for the employee will be determined by his work experience and abilities.
In addition, the new measures will also monitor the conduct of employers. There will be restrictions to charge foreign workers with fees than those permitted by the Canadian government program. It also prohibits employers to keep personal property such as official documentation and passports of foreign workers.
Another new responsibility for the employers is that they have to inform CNESST about the arrival and departure times of temporary foreign workers.
